    Commercial, Procurement & Construction

    Eduardo W. Gonzalez, Section Head

    The Commercial, Procurement and Construction Section is a multi-disciplinary group of attorneys who represent and advise County officials and departments on a wide variety of transactional matters, including the procurement and contracting for the purchases of goods and services, public construction projects, professional services, including architectural, design and engineering services, and large-scale public-private partnerships ("P3s") agreements. We also assist in the preparation and adoption of a County budget in excess of 11 billion dollars, which provides funding for the Miami-Dade Aviation, Transportation, Police, Fire-Rescue, and Water & Sewer departments, PortMiami, more than 20 other departments, and the County's 30,000 employees and contractors. Our work includes complex commercial transactions which must comply with general commercial law, as well as statutes and regulations relating to public contracts that do not apply in the private sector. For example, we work closely with the County's Strategic Procurement Department in all aspects of the competitive bidding process to protect the public interest, including the preparation of competitive solicitations for County contracts, legal reviews of bids and responses to County bids, and providing legal representation during contract formation and negotiations. We also collaborate with the Office's Real Estate, Facilities, Recreation & Culture Section in projects that involve real estate acquisition and subsequent construction and development. After contracts are finalized, we provide ongoing legal advice regarding contract management and enforcement.

    Attorneys in this section are both transactional attorneys and commercial litigators, representing the County in lawsuits arising from County contracts. We have tried cases in both federal and state courts and before arbitration panels that typically originate as breach of contract cases, and often present complex statutory and constitutional issues, novel legal questions, sophisticated accounting issues, and intriguing facts. Additionally, we represent the County in administrative hearings, defending the legality of competitive contract award recommendations, debarring private contractors from entering into future County contracts, and enforcing County policies and legislation on minimum wage rates or small business participation in County contracts. Our lawyers act as counsel to the Board of County Commissioners and the County Mayor in the preparation of County legislation related to government contracting policies and initiatives.
