Ben Simon practices primarily in the Office's Environmental, Code Enforcement, and Foreclosures Section. Ben files and litigates legal actions to enforce the Code of Miami-Dade County, seeking to protect the environment, ensure nuisance abatement, and obtain compliance with building, zoning, unsafe structures, and fire regulations.

Previously, Ben practiced in the Office's Tort and Medical Malpractice section. As a seasoned litigator and trial attorney, Ben has served as lead counsel in numerous cases at both trial and appellate levels defending the Public Health Trust in personal injury and medical malpractice actions, as well as defending Miami-Dade County in cases involving allegations of wrongful death, motor vehicle negligence, battery, negligent and intentional infliction of emotional distress, defamation, premises liability, negligent hiring, retention, and supervision, false arrest, malicious prosecution, property damage, and excessive force.

Ben has also represented the Construction Trades Qualifying Board, the Unsafe Structures Board, the Miami-Dade Police Department on matters involving legislation before the Board of County Commissioners, execution of writs, and replevin actions, and the Miami-Dade Corrections and Rehabilitation Department on matters including responding to petitions for writs of habeas corpus, the legality of court orders directed at the Department, transportation of detainees, and the medical and mental health treatment of the County's inmate population.

Before joining the County Attorney's Office, Ben worked at the State Attorney's Office for Miami-Dade County. As a state prosecutor, Ben litigated and tried many criminal cases, involving a wide range of offenses including DUI manslaughter, vehicular homicide, reckless driving, burglary, robbery, driving with a suspended license as a habitual traffic offender, sexual battery, extortion, possession of and trafficking in controlled substances, grand theft, domestic violence, aggravated assault and battery, and attempted murder.

Prior Experience

  • Assistant State Attorney, Office of the Miami-Dade County State Attorney, 2003-2006, where he served as an Assistant Chief in the misdemeanor traffic and DUI unit supervising 50 attorneys on direct file case, as well as a division prosecutor in the felony unit.
