MIAMI-DADE COUNTY AFFORDABLE HOUSING ADVISORY BOARD
AUTHORITY: 17-106 MIAMI-DADE COUNTY CODE
DESCRIPTION: THE AFFORDABLE HOUSING ADVISORY BOARD AS THE AFFORDABLE HOUSING ADVISORY COMMITTEE SHALL REVIEW MIAMI-DADE COUNTY'S ESTABLISHED POLICIES AND PROCEDURES, ORDINANCES, LAND DEVELOPMENT REGULATIONS, AND ADOPTED COMPREHENSIVE PLAN AND SHALL MAKE RECOMMENDATIONS TO THE BOARD OF COUNTY COMMISSIONERS REGARDING SPECIFIC ACTIONS OR INITIATIVES TO ENCOURAGE OR FACILITATE AFFORDABLE HOUSING WHILE PROTECTING THE ABILITY OF PROPERTY TO APPRECIATE IN VALUE. THE RECOMMENDATIONS MAY INCLUDE THE MODIFICATION OR REPEAL OF EXISTING POLICIES, PROCEDURES, ORDINANCES, REGULATIONS, OR PLAN PROVISIONS, THE CREATION OF EXCEPTIONS APPLICABLE TO AFFORDABLE HOUSING, OR THE ADOPTION OF NEW POLICIES, PROCEDURES, REGULATIONS, ORDINANCES, OR PLAN PROVISIONS, INCLUDING RECOMMENDATIONS TO AMEND THE ADOPTED COMPREHENSIVE PLAN AND CORRESPONDING REGULATIONS, ORDINANCES, AND OTHER POLICIES.
COMPOSITION: **EFFECTIVE OCTOBER 1, 2020 THE COMMITTEE MUST CONSIST OF ONE LOCALLY ELECTED OFFICIAL FROM EACH COUNTY OR MUNICIPALITY- PER HB 1339** THE AFFORDABLE HOUSING ADVISORY BOARD SHALL CONSIST OF FIFTEEN (15) MEMBERS. (1)THE BOARD OF COUNTY COMMISSIONERS SHALL APPOINT THIRTEEN (13) MEMBERS: I. ONE (1) CITIZEN ACTIVELY ENGAGED IN THE RESIDENTIAL HOME BUILDING INDUSTRY AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. II. ONE (1) CITIZEN ACTIVELY ENGAGED IN THE BANKING OR MORTGAGE BANKING INDUSTRY AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. III. ONE (1) CITIZEN REPRESENTATIVE OF THE AREAS OF LABOR ACTIVELY ENGAGED IN HOME BUILDING AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. IV. ONE (1) CITIZEN WHO IS ACTIVELY ENGAGED AS AN ADVOCATE FOR LOW-INCOME PERSONS IN CONNECTION WITH AFFORDABLE HOUSING AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. V. ONE (1) CITIZEN WHO IS ACTIVELY ENGAGED AS A FOR-PROFIT PROVIDER OF HOUSING AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. VI.ONE (1) CITIZEN WHO IS ACTIVELY ENGAGED AS A NOT-FOR-PROFIT PROVIDER OF AFFORDABLE HOUSING AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. VII. ONE (1) CITIZEN WHO IS ACTIVELY ENGAGED AS A REAL ESTATE PROFESSIONAL AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. VIII. ONE (1) CITIZEN WHO ACTIVELY SERVES ON THE LOCAL PLANNING AGENCY PURSUANT TO SECTION 163.3174, FLORIDA STATUTES AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. IX. ONE (1) CITIZEN WHO RESIDES WITHIN THE JURISDICTION OF THE LOCAL GOVERNING BODY MAKING THE APPOINTMENTS AS REQUIRED BY SECTION 420.9076(2), FLORIDA STATUTES. X. ONE (1) CITIZEN WHO REPRESENTS EMPLOYERS WITHIN THE JURISDICTION. XI. ONE (1) CITIZEN WHO REPRESENTS ESSENTIAL SERVICES PERSONNEL, AS DEFINED IN THE LOCAL HOUSING ASSISTANCE PLAN. XII. FOR THE REMAINING TWO (2) MEMBER POSITIONS, THE BOARD OF COUNTY COMMISSIONERS MAY CONSIDER THE APPOINTMENT OF A MEMBER OF THE CONSTRUCTION INDUSTRY, A LOCAL COMMUNITY DEVELOPMENT CORPORATION, AN ATTORNEY, AN ARCHITECT, AN ENGINEER, OR PLANNING PROFESSIONALS. (2)THE MAYOR SHALL APPOINT ONE (1) MEMBER WHO IS A MEMBER OF THE CONSTRUCTION INDUSTRY, LOCAL COMMUNITY DEVELOPMENT CORPORATION, ATTORNEY, ARCHITECT, ENGINEER, PLANNING PROFESSIONAL. (3)THE OVERALL TENANT ADVISORY COUNCIL ("OTAC") SHALL APPOINT ONE (1) OF ITS MEMBERS.
QUALIFICATIONS: RESIDENTS AND ELECTORS OF MIAMI-DADE COUNTY WHO HAVE OUTSTANDING REPUTATIONS FOR INTEGRITY, RESPONSIBILITY, AND COMMITMENT TO SERVING THE COMMUNITY, AND ARE: ACTIVELY ENGAGED IN THE RESIDENTIAL HOME BUILDING INDUSTRY; ACTIVELY ENGAGED IN THE BANKING OR MORTGAGE BANKING INDUSTRY; REPRESENTATIVES OF THE AREAS OF LABOR ACTIVELY ENGAGED IN HOME BUILDING; ACTIVELY ENGAGED AS ADVOCATES FOR LOW-INCOME PERSONS IN CONNECTION WITH AFFORDABLE HOUSING; ACTIVELY ENGAGED AS FOR-PROFIT PROVIDERS OF HOUSING; ACTIVELY ENGAGED AS NOT-FOR-PROFIT PROVIDERS OF AFFORDABLE HOUSING; ACTIVELY ENGAGED AS REAL ESTATE PROFESSIONALS; ACTIVELY SERVING ON A LOCAL PLANNING AGENCY; RESIDENTS WITHIN THE JURISDICTION OF THE LOCAL JURISDICTION OF THE LOCAL GOVERNING BODY MAKING THE APPOINTMENTS REPRESENTATIVES OF EMPLOYERS WITHIN THE JURISDICTION; AND REPRESENTATIVES OF ESSENTIAL SERVICES PERSONNEL, AS DEFINED IN THE LOCAL HOUSING ASSISTANCE PLAN. NO ONE WILL BE ELIGIBLE TO SERVE ON THE AFFORDABLE HOUSING ADVISORY BOARD IF HE/SHE OWNS A FINANCIAL INTEREST IN, IS EMPLOYED BY, OR IS AN OFFICER OF ANY ENTITY THAT RECEIVES OR APPLIES FOR FUNDING FROM MIAMI-DADE COUNTY THROUGH THE AFFORDABLE HOUSING ADVISORY BOARD. A PERSON IS PROHIBITED FROM SERVING ON A COUNTY BOARD WHERE SUCH SERVICE WOULD VIOLATE FEDERAL OR STATE LAW, THE MIAMI-DADE COUNTY HOME RULE CHARTER, OR COUNTY ORDINANCE.
APPOINTMENT PROCESS: A FLORIDA CRIMINAL HISTORY BACKGROUND CHECK WILL BE CONDUCTED ON PERSONS SELECTED FOR APPOINTMENT BY INDIVIDUAL COMMISSIONERS. AS PRESCRIBED BY SECTION 2-11.38.1 OF THE CODE OF MIAMI-DADE COUNTY. •BACKGROUND RESEARCH WILL BE CONDUCTED ON PERSONS REQUIRING NOMINATION, APPOINTMENT, RATIFICATION, AND/OR WAIVER BY THE BOARD OF COUNTY COMMISSIONERS. OF WHICH THE FINDINGS OF THE SUCH RESEARCH WILL BE PLACED ON THE COMMISSION’S AGENDA FOR CONSIDERATION. •NOMINATING COMMISSIONER SUBMITS PART 1 OF THE NOMINATION/APPOINTMENT FORM TO THE CLERK OF THE BOARD. THE FLORIDA CRIMINAL HISTORY BACKGROUND CHECK WILL THEN BE INITIATED. COMMISSIONER CONSIDERS APPOINTMENT OR WITHDRAWAL OF NOMINATION BASED ON THE RESULTS OF THE BACKGROUND CHECK AND SUBMITS PART II OF THE NOMINATION/APPOINTMENT FORM TO THE CLERK. •COMMISSIONER READS APPOINTMENTS INTO THE RECORD AT A REGULAR COUNTY COMMISSION MEETING. •ALL OTHER APPOINTMENTS ARE SUBMITTED TO THE CLERK OF THE BOARD. •BOARD MEMBERS ARE REQUIRED TO COMPLY WITH STATE AND/OR COUNTY FINANCIAL DISCLOSURE REQUIREMENTS AND FILE FINANCIAL FORMS BY JULY 1ST OF EACH YEAR WITH THE STATE OF FLORIDA COMMISSION ON ETHICS OR MIAMI-DADE COUNTY SUPERVISOR OF ELECTIONS RESPECTIVELY. •BOARD MEMBERS SHALL ALSO DISCLOSE ANY GIFT, OR A SERIES OF GIFTS FROM ANY PERSON OR ENTITY, HAVING A VALUE IN ACCESS OF $100 BY FILING THE REQUIRED GIFT DISCLOSURE FORM WITH THE CLERK OF THE BOARD.
